All accounts are payable net upon receipt of invoice. A 1.5% service fee will be applied to accounts that are not fully paid 30 days after the billing date. The first page of this simple contract describes the work to be done and may include options if the tree service offers alternative approaches to the work it offers. It also includes your authorization signature, which is your consent for the tree service to perform the work described. Ownership: The authoritative party warrants that all trees listed are located on the customer`s property and, if not, that the authoritative party has obtained full written permission from the owner to allow martin Tree Service to perform the specified work. If a tree is wrongly identified as property, the customer undertakes to indemnify Martin Tree Service for any damage or cost incurred as a result. Agreement and Authority: By accepting, the Client declares that it has full authority to sign this Agreement for the Work indicated at the agreed address where the Work is to be completed. This is the entire agreement between the parties, and all prior discussions, negotiations and representations are merged and superseded by this Agreement, and Customer may not rely on such matters prior to this Agreement or oral agreements before, during or after the date of the Agreement. The second page now deals with some of the most sensitive issues, such as insurance .B. For simplicity, this part of the contract can be distinguished from the first page by being called the “Terms and Conditions”. Working with nature Trees and plants are natural living organisms that are influenced by factors beyond human control. No guarantee is given expressly or implicitly for trees, plants or the safety, health or general condition of the landscape. 14. Treatments, Fertilization and Plant Health: Very Good Tree Service does not provide any guarantee as to the effectiveness or success of tree or plant treatments. We recommend treatment because we believe the tree is a valid candidate for treatment at this time. Licenses/Permits: Martin Tree Service is responsible for the cost of insurance, licenses and/or bonds required to perform certain work under this Agreement in order to comply with all applicable local and federal regulations, rules and regulations. The client/owner is responsible for obtaining and paying for the necessary permits and permits from the local HOA and other governing bodies (cities and municipalities). In many cases, local cities need a permit to perform work that requires on-street parking while performing work for a local resident. 17. Insurance/Indemnification: Very Good Tree Service has insurance that provides coverage in the event of injury to persons or property directly attributable to the negligence of Very Good Tree Service and/or its employees.
In addition, all employees of Very Good Tree Service are covered by workers` compensation insurance. Once the work subject to this Agreement has been performed by Very Good Tree Service, the Customer/Owner agrees to indemnify and hold harmless Very Good Tree Service, its employees and agents from any injury, loss or expense in any way in connection with the services provided under this Agreement, unless expressly stated above. In no event shall Very Good Tree Service be liable to the Customer/Owner for damages of any kind suffered more than six (6) months after the completion of the scope of the work subject to this Agreement, whether the damage is caused by the work performed by or on the instructions of Very Good Tree Service. The parties hereto further agree that the Customer/Owner may not under any circumstances claim damages beyond the applicable liability of Very Good Tree Service. 6. Tree Ownership: The Customer warrants that all trees/stumps listed or mentioned in the Offer, in any communication from the Customer and in any order of modification are either: (1) located on the Customer`s property; and/or (2) the Customer has received full authorization from the Owner to enter into this Agreement. If a tree or stump is incorrectly identified as property, customer agrees to indemnify Very Good Tree Service for any damage or cost incurred as a result in accordance with the indemnification provision contained herein. Governing Law: The terms of this Agreement shall be construed and governed by the laws of the State of Indiana; Location and venue are limited only to the District Court for hamilton County, Indiana. The Customer undertakes to bear all costs, agency fees, arbitration costs and expenses, as well as all costs and expenses of the Customer. The customer undertakes to limit the damages that may be claimed in legal proceedings to an amount equal to the amount of this contract. Customer hereby waives the right to a jury trial with respect to claims made by or against Martin Tree Service. Acme Tree Service is fully insured and all employees are covered by workers` compensation, property damage, liability insurance and comprehensive business insurance. Removing or performing major pruning on a large landscaped tree is not an easy task, which is why most homeowners hire a professional tree service for such work. You must have a detailed contract that specifies the work to be done, the terms of payment, and any liability issues, including insurance coverage. 2. Customer: Unless otherwise agreed, the Customer is the person to whom the offer is addressed, together with his employer or client.
The client guarantees that he is fully entitled to bind and bind his employer / client to this contract. It is agreed between Martin Diversified Services, LLC d/b/a Martin Tree Service hereinafter referred to as “Martin Tree Service” or “Company” and the authoritative party (Customer, Customer and/or Customer Representative) agrees that the following provisions will be made under this Agreement: a. Entry into the Work Area: The Customer undertakes not to enter the Work Area during the execution of the Work, unless the team leader on site has approved it. The customer also undertakes to keep the work area free and free of all employees, family members, children and pets. Very Good Tree Service is not responsible for pets that come out of a pen. b. Cleaning the work area: The customer must remove all toys, furniture, decorations, swings, ornaments, potted plants, nest boxes, lighting, wind chimes, flags, hammocks, tree swings and all other valuables from the work area before starting the work. If you are unable to move some of these items in advance, need our help, or simply do not complete this process, you automatically waive the right to hold us liable for any damage caused.
5. Minimum Visit Fee: Very Good Tree Service charges at least $250 for tree work. Although lower amounts may appear broken down in the proposal, they cannot be selected individually. The customer guarantees that all trees, plant material and things to work belong to him or that permission for the work has been obtained from the owner. Acme Tree Service, Inc. shall be indemnified against all claims for damages resulting from the customer`s failure to obtain such approval. .
